Website Terms and Conditions of Use

Anyone using the information, documents, products, software and other services (together, the "Services") offered on the Site is deemed to have read and accepted these Terms and Conditions of Use in full.

Quelle est la durée maximale d'un stage au Luxembourg ?

Un stage pratique ne peut pas dépasser 26 semaines chez le même employeur sur une période de 24 mois. Les stages conventionnés, eux, n’ont pas de durée maximale fixée par la loi.

Oui, au prorata de la durée du stage. Pour un stage d’un an complet, le stagiaire bénéficie de 26 jours de congé de récréation.

Pas sans limite. Les périodes de stage chez un même employeur sont cumulées sur 24 mois. Dès que le total dépasse 26 semaines, l’entreprise doit soit mettre fin à la collaboration, soit proposer un contrat de travail.

L’absence de convention expose l’entreprise à des sanctions de l’ITM et, dans les cas les plus graves, à une requalification du stage en contrat de travail avec toutes les obligations sociales et fiscales qui en découlent.

User obligations

The Site is accessed via the internet. Users acknowledge and accept the risks this involves, and must take suitable precautions against hacking by using a properly secured computer configuration.

The Company cannot be held liable for any damage users may suffer, directly or indirectly, in connection with their use of the Site, its Services, or the websites it links to.

Cookie Management

The Site uses client-side cookies — small text files — to analyse browsing information (tracking cookies via Google Analytics, covering visit frequency and duration, pages viewed, language preferences, statistics, etc.) and to improve the browsing experience (functional cookies required for the Site to work properly). Cookies are stored in a dedicated folder on the user's device and may also be placed by third parties the Company works with. Each cookie typically contains the name of the server that created it, a unique identifying number, and an expiry date; the unique identifier lets the Site recognise the user's device on each visit. Session cookies are deleted once the session ends, while persistent cookies remain on the device for 12 months after the session closes.

Users can decide whether the Site's web server may store cookies on their device, and may adjust their browser settings at any time to accept or reject cookies, or to delete cookies already stored.

Changes to the Site

The Company reserves the right to develop, modify or suspend the Site without notice, for maintenance, updates or any other reason it deems necessary, including removing, adding to, supplementing or clarifying any information or services on the Site. The Company accepts no liability for any direct or indirect damage arising from such changes.

Limitation of liability 

The Company will use its best efforts to keep the Site available at all times, but cannot be held liable for any temporary or total unavailability.

The Company will use its best efforts to secure its IT systems.

The Company will use its best efforts to ensure the accuracy of the information and Services on the Site and on social media, and of the advice it provides. However, it cannot be held liable for outdated information or forms, system or encoding errors, gaps or inaccuracies in the information provided, or any errors or omissions in the Site's responses. While the Company aims to share accurate, up-to-date information from a range of sources, it cannot rule out the risk of factual error. Nothing published on the Site, or provided in response to an individual request, is intended to be exhaustive or to constitute a commitment on the Company's part. Simplified explanations and translations are provided for information purposes only, and the information on the Site is general in nature — it does not account for personal or specific circumstances and should not be treated as personal, professional or legal advice. 

The Site's liability is expressly excluded for all direct and indirect consequences arising from:

• Incompatibility between the service offered and the user's or a third party's equipment, applications, procedures or infrastructure;

• A security breach originating from the user or a third party, or more generally any security breach not directly attributable to the Site;

• Errors and/or fraud committed by the user or a third party;

• Any unavailability or malfunction of electronic communication systems or networks.

Data submitted to third parties via forms downloaded from the Site remains the responsibility of the user and of the recipient once transmitted.

The Company reserves the right to terminate, without notice or compensation, access to any personal area on the Site found to be used unlawfully or fraudulently.

The Company cannot be held liable for collecting or processing the personal data of minors under 16 without the effective consent of their legal representatives, or for incorrect data — particularly regarding age — supplied by minors. Personal data will never be processed by the Data Controller where a user states they are under 16.

Links to other sites

For users' convenience, the Site may contain links to other sites that may be useful or of interest to them. The Company does not systematically review the content of these sites and cannot be held liable for it, whether in terms of legality or accuracy.

Intellectual property

The Site, all of its components (including its layout), and its information and Services are protected by intellectual property and copyright law.

Unless stated otherwise, the Company grants no licence or authorisation over the intellectual property rights it holds in the Site, its content or its Services. No reproduction of any information or Service, in whole or in part, in any form or by any means, is permitted without the Company's prior written consent.

Unless stated otherwise, users may view, download and print the documents and information available on the Site, subject to the following conditions :

• Documents may only be used for personal, informational purposes in a strictly private context;

• Documents and information may not be modified in any way;

• Documents and information may not be distributed outside the Site.

The rights granted to users above, whether implicit or explicit, constitute permission to use the Site — never a transfer of any rights, ownership or otherwise, over it.

These Terms and Conditions of Use may be modified or supplemented at any time, without notice, to reflect changes to the Site, developments in legislation, or any other reason the Company deems necessary. Only the version published online at any given time is in force, and it is the user's responsibility to review it regularly, since the terms may change between visits.

Governing law and jurisdiction

Any dispute relating to the use of the Site and its Services is governed by Luxembourg law and falls under the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg.

Terms specific to the myomnitrust service on the Site

This Service, available via the Site, gives the Company's clients access to information made available to them in a restricted-access area.

Use of the Service is free of charge and, unless the law requires otherwise, optional. 

Availability and development of the Service 

The Service is, in principle, available 24/7. The Company nonetheless reserves the right to develop, modify or suspend it without notice for maintenance, technical or physical incidents, or any other reason it deems necessary. Unavailability of the Service gives no right to compensation, and the Company cannot be held liable if a user misses a deadline due to temporary unavailability of the Site and/or Service, nor for any direct or indirect damage linked to changes or developments to the Service.

Protection of personal data

Personal data provided by users is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (GDPR).

The Company implements technical and organisational security measures to ensure an appropriate level of confidentiality, integrity, availability and resilience for the services offered via the Site, and to protect users' rights and freedoms in line with industry standards. Only authorised staff and users may access personal data, and only for legitimate purposes. Unless stated otherwise in these Terms, user data is stored in countries offering an adequate level of protection.

Users have the right to access, rectify and erase their data. These rights may be exercised with the relevant data controller, where applicable through the features available on the Site.

If a technical issue prevents users from exercising these rights via the Site, they may contact the Company directly.

Users also have the right to restrict processing, to object to processing, to withdraw consent, and to data portability. These rights may be exercised directly with the relevant data controllers.

Users may lodge complaints about the protection of their data through the relevant communication channels, or directly with the data controller concerned. Complaints may also be sent to the Company's Data Protection Officer at info@omnitrust.lu, or to the National Commission for Data Protection (CNPD).

Processing related to event logs

Users consent to data on their Site activity (identifier, action or feature used, date and time, parameters) being retained so it can be made available to the relevant data controllers or judicial authorities in the following limited circumstances:

• To resolve an information-security incident, in the legitimate interest of keeping the Site secure;

• To establish, exercise or defend a legal claim, in judicial, administrative or extrajudicial proceedings relating to the activity in question.

The relevant data controller depends on the feature being reviewed, and only that controller has access to the corresponding data.

Users are informed that this data is kept confidential to the highest standards, and extracts are only released on express, justified request from a data controller or judicial authority.

Processing related to newsletter management 

The email address provided when subscribing to this Site's newsletter is shared solely for newsletter distribution purposes, with a processor — namely Mailjet, based in Paris, France — which is subject to the same legal obligations on personal data protection. To prevent misuse, users must confirm their subscription by clicking a link sent to the email address provided.

Users may unsubscribe at any time via the link included in every email, or by contacting the Site. Any issues with the newsletter should also be reported to the Site. User data is kept only for as long as the subscription lasts.

The Company is the controller for this processing.

Site processing related to audience measurement

Certain non-identifying data about a user's hardware and software is collected during their visit to the Site, purely to compile visitor statistics (browser type, screen resolution, approximate location, etc.) so as to serve users better. Full IP addresses are not retained.

This data is stored via Google Analytics, which is subject to the same legal obligations on personal data protection.

Data is kept only as long as needed to track audience trends against changes in browsers, screen resolutions or other available statistics.

Social media presence

Moderation policy

Anyone joining the Site's community on social media agrees to refrain from any form of discrimination based on race, colour, religion, sex, sexual orientation, age, national origin, disability, or professional or marital status.

Insulting, racist, sexist or otherwise offensive comments have no place on social media and will be removed and reported.

The Company's social media accounts are primarily intended to relay information and content published on the Site. They are not designed to handle requests, questions or comments containing personal data such as full names, national ID numbers, dates of birth, phone numbers, email addresses, or attachments or scans of documents containing personal data.

For such requests, questions or comments, users should instead use the contact form available on the Site.

Requests, questions or comments containing personal data made on the Company's social media accounts (regardless of the user's account handle on the platform concerned) will not be processed and will, wherever possible, be deleted.

The Company's Facebook, Twitter, LinkedIn and other social media accounts are, in principle, monitored Monday to Friday, 8:00 a.m. to 6:00 p.m. Outside these hours, and during weekends and public holidays, pages are not continuously moderated.
