In Luxembourg, a tax representative is a qualified professional whom an individual or a business entrusts with managing their obligations to the Direct Taxation Administration (ACD) or the Administration of Registration, Domains, and VAT (AED).

The agent then acts as an official intermediary. Their responsibilities generally include preparing tax returns, providing strategic advice, handling administrative correspondence, and handling registration. 

For foreign companies that carry out VAT-subject transactions in Luxembourg without being established there, appointing an agent (or a tax representative for non-EU countries) is often an essential step in complying with local law.

The role of tax representative is highly regulated in the Grand Duchy, and only certain professionals are authorized to provide these services. This includes, for example, members of the Order of Chartered Accountants, of which we are a part, as well as attorneys.

In Luxembourg, the definition of a VAT-registered entity is very broad. As of 2026, the rules are based on the principle of independence and the nature of the business.

Any individual (self-employed, freelance) or legal entity (such as an LLC or corporation) that:

  • Engages in economic activity on a self-employed basis (without an employer-employee relationship).

  • Performs tasks on a regular basis (rather than occasionally).

  • Whether it operates for profit or not, the financial outcome is irrelevant.

In addition, there are numerous special cases, often involving thresholds. Certain categories are subject to the requirement but are exempt from payment.
